Terms and Conditions

Welcome to Clayton’s Stay Safe Driving. By booking a driving lesson or package with me, you (the "pupil" or "student") agree to the following terms and conditions:

1. Driving Licences and Fitness to Drive

  • Licence Check: You must hold a valid UK driving licence (provisional or full). You must present your physical licence on or before your first driving lesson, along with a licence check code if requested, so your entitlements can be verified.

  • Fitness to Drive: It is your legal responsibility to ensure you are fit to drive. You must wear any corrective footwear or eyewear (glasses/contact lenses) required to meet the DVSA eyesight standard.

  • Health Conditions & Medications: You must immediately inform me of any changes to your physical or mental health, or any medications that could affect your ability to drive safely.

  • Sobriety: I operate a strict zero-tolerance policy for substances. If I suspect you are under the influence of alcohol, illegal drugs, or prescription medication that impairs your driving, the lesson will be terminated immediately, and the full lesson fee will be forfeited.

2. Payments and Refunds

  • Upfront Payments: To secure any individual lesson or discounted block package slot in the diary, payment must be made upfront.

  • The 96-Hour Rule: Payment for all lessons must be cleared at least 96 hours before the scheduled start time of the lesson. If payment is not received 96 hours in advance, your booking will be cancelled, and the slot may be offered to another student.

  • Refunds: Block bookings are non-refundable once lessons have commenced, except under exceptional circumstances at my discretion. Any agreed refunds for unused block booking hours will be calculated by charging for the used hours at the standard individual hourly rate of £40, forfeiting the package discount.

3. Strict 48-Hour Cancellation Policy

  • Notice Period: If you need to cancel or reschedule a lesson, you must give a minimum of 48 hours notice.

  • Late Cancellations: If you cancel or rearrange within 48 hours of your scheduled lesson start time, the full lesson fee will be charged. For block bookings, the duration of the lesson will be deducted from your remaining balance.

4. Punctuality and Lateness

  • Pupil Lateness: If you are late for a lesson, please notify me as soon as possible. I will wait at the agreed pickup location for a maximum of 15 minutes after the scheduled start time. If you do not arrive within these 15 minutes, the lesson will be cancelled, and your lesson fee will be completely forfeited.

  • Instructor Lateness: If I am running late due to unpredictable traffic, road incidents, or delays, I will text or call you as soon as it is safe to do so. Any time lost due to my delay will either be added to the end of that lesson or carried forward to a future lesson, as mutually agreed between us.

5. Privacy Policy & Data Management (GDPR Compliance)

  • Data Protection: In accordance with the General Data Protection Regulation (GDPR) and UK data protection laws, any personal data collected from you (including your name, address, contact details, driving licence number, and progress records) will be stored securely and treated with strict confidentiality.

  • Usage: Your data will only be used for the purposes of managing your driving tuition, processing payments, arranging test bookings, and contacting you regarding your lessons.

  • Third Parties: Your personal data will never be sold, shared, or passed on to third parties for marketing purposes. It will only be shared with official bodies (such as the DVSA) when strictly necessary to manage your practical driving test.

  • Your Rights: You have the right to request a copy of the personal data held about you, or to request that your data be deleted once your tuition has concluded and legal retention requirements are met.

6. Alterations and Amendments

  • I reserve the right to amend these terms and conditions, or alter lesson prices, by giving you reasonable advance notice.
